Gilbert Flores was convicted of manslaughter and was sentenced to serve a 10-year sentence in the Idaho Penitentiary. The 10-year sentence was imposed on November 29, 1977. Flores was actually confined until November 18, 1981, when he was paroled under the supervision of the Board of Corrections. Flores violated his parole and was reincarcerated on November 3, 1983. The parole board rejected Flores request that the 719 days which he had spent on parole be credited toward his 10-year sentence, based upon I.C. § 20-228[Footnote 1] which clearly provides that the time spent on parole shall not be considered to have been served as a part of a prisoners
